Terms of Service

Netlink Technologies (“Netlink”, “we”, “our”, or “us”) provides domain registration, shared hosting, reseller hosting, VPS hosting, dedicated servers, and related web infrastructure services.

By purchasing or using our services, you confirm that you have read, understood, and agreed to our Terms of Service and Privacy Policy.

All services, including VPS, Dedicated Servers, and Domain registrations, are non-refundable once provisioned or activated.

1. Agreement Overview

This Agreement governs all services provided by Netlink Technologies through our website and infrastructure.

By using our services, you confirm that:

  • You are at least 18 years of age
  • You agree to comply with applicable laws
  • You accept these terms in full

If you do not agree, you must not use our services.

2. Account Activation

New hosting accounts are generally activated within 2–3 hours after payment confirmation. In some cases, activation may take up to 24 hours due to payment verification or fraud screening.

We reserve the right to delay or decline activation if payment appears suspicious or originates from unverified sources.

3. Billing, Renewals & Payments

Invoices are generated 7 days before the renewal date.

Failure to make payment will result in:

  • Suspension 7 days after renewal date
  • Termination 3 days after suspension if unpaid

3.1 Suspension for Non-Payment

Suspended accounts will not be accessible until all outstanding dues are cleared.

3.2 Account Restoration

If an account is terminated due to non-payment:

  • Restoration is subject to backup availability
  • A restoration fee of ₹2,500 applies
  • All outstanding renewal fees must be paid

We do not guarantee data availability after termination.

Failure to receive invoice notifications does not remove payment responsibility.

4. Refund Policy

4.1 30-Day Money Back Guarantee (Shared Hosting Only)

We offer a 30-day money back guarantee for first-time shared hosting purchases only.

This guarantee:

  • Applies only once per client
  • Does not apply to renewals
  • Does not include prorated refunds
  • Is void if account is suspended for policy violations

Refund processing may take up to 60 days.

4.2 Non-Refundable Services

The following services are strictly non-refundable:

  • Domain registrations and renewals
  • Domain transfers
  • VPS hosting
  • Dedicated servers
  • Reseller hosting
  • SSL certificates
  • Setup fees
  • Add-on services
  • Promotional or discounted packages
  • Web development services

4.3 No Refund Policy (Digital Services & Domains)

All payments made for VPS, Dedicated Servers, Cloud Services, and Domain Registrations are non-refundable once the service has been provisioned, activated, or delivered.

Due to the nature of digital infrastructure and instant provisioning, no refunds will be issued under any circumstances, including but not limited to:

  • Change of mind
  • Lack of technical knowledge
  • Service no longer required
  • Failure to cancel before renewal

By completing a purchase, the client acknowledges and agrees to this no-refund policy.

4.4 Domain Registration & Renewal Policy

All domain name registrations, transfers, and renewals are final and non-refundable.

Once a domain is registered or renewed, it cannot be reversed, canceled, or refunded due to registry policies.

The client is solely responsible for:

  • Entering correct domain names
  • Managing renewals and expiration dates

No exceptions will be made under any circumstances.

4.5 Service Delivery & Acceptance

A service is considered successfully delivered when:

  • Login credentials, server details, or domain confirmation are sent to the registered email address, and/or
  • The service becomes accessible via provided credentials or control panel

This constitutes full fulfillment of the service obligation.

4.6 Disputes & Chargebacks

Clients agree to contact our support team before initiating any dispute or chargeback.

Initiating a chargeback or dispute without prior communication may result in:

  • Immediate suspension or termination of all services
  • Permanent account restriction

We reserve the right to submit all relevant evidence, including service logs, IP access records, and communication history, to resolve disputes.

4.7 Binding Agreement

By placing an order, the client confirms that they have read, understood, and agreed to our Terms of Service, Privacy Policy, and Refund Policy.

5. Acceptable Use Policy

All services must be used for lawful purposes only.

5.1 Prohibited Content

The following content is not permitted:

  • Pornographic or adult material
  • Copyrighted content without authorization
  • Defamatory or unlawful content
  • Malware or harmful code

5.2 Prohibited Activities

The following activities are strictly prohibited:

  • Spam or bulk unsolicited email
  • Phishing or fraud schemes
  • IRC servers, bots, or clients
  • Proxy or anonymizer services
  • Torrent or file-sharing services
  • Warez, nulled scripts, cracks, serial numbers
  • File hosting or download-only platforms
  • Gambling platforms
  • High resource abusive scripts

Accounts violating these policies may be suspended or terminated without prior notice.

6. Email & Anti-Spam Policy

To protect server integrity:

  • 500 emails per hour per domain limit
  • 60 POP3/IMAP checks per hour per mailbox
  • Mailing lists must be Double Opt-In
  • Purchased or third-party lists are prohibited
  • Direct SMTP mailers are not allowed

6.1 Zero Tolerance Spam Policy

We maintain a strict zero-tolerance stance against spam.

Accounts involved in spam activity will be suspended immediately. Repeated violations will result in permanent termination.

If server IP addresses are blacklisted due to your actions, cleanup and remediation costs may be charged to your account.

7. Reseller Terms Agreement

7.1 Independent Business Status

Resellers operate as independent businesses. Nothing in this Agreement creates a partnership, agency, or joint venture.

7.2 Responsibility for End Customers

Resellers are fully responsible for:

  • Content hosted under their reseller accounts
  • Billing and payment collection from their customers
  • Providing first-level technical support
  • Handling abuse complaints

Netlink does not provide direct support to reseller end customers.

7.3 Domain Accreditation Disclosure

Netlink Technologies is an accredited .IN domain registrar.

For all other domain extensions (including but not limited to .COM, .ORG, .NET), registrations are processed through authorized partner registrars.

Policies, domain lifecycle events, DNS propagation, and transfer procedures for non-.IN domains are governed by the respective registries and partner registrars.

Domain availability is not guaranteed until successful registration is completed.

7.4 Abuse Under Reseller Accounts

Resellers must respond to abuse complaints within 48 hours.

Failure to respond may result in suspension of the affected account or the entire reseller account.

8. Server Resource Usage

Shared and reseller hosting accounts must not:

  • Use more than 10% of server resources continuously
  • Run background daemons
  • Operate high-load applications
  • Host storage-only or media archive services

Accounts causing server instability may be suspended without notice.

9. Large File Policy

Hosting services are intended for website hosting only.

Files larger than 50MB made available solely for download are not permitted.

Unlimited storage is subject to fair and reasonable website usage.

10. Security Responsibilities

Clients are responsible for:

  • Maintaining strong passwords
  • Updating scripts, plugins, and applications
  • Securing account credentials
  • Protecting hosted content

Clients are liable for activities originating from their account unless proven to result from unauthorized external compromise.

11. Backups & Data Responsibility

Backups are maintained for internal disaster recovery purposes only.

We do not guarantee backup availability or restoration.

Clients must maintain independent backups of all website data.

Data recovery due to client negligence may incur a ₹2,500 service fee.

12. Domain Registration & Renewals

Clients are responsible for monitoring domain expiry dates.

We recommend renewal payments at least 20 days before expiry.

We do not guarantee domain renewal unless advance payment is received.

Registrar-controlled features are beyond our control.

13. IP Address Ownership

All assigned IP addresses remain the property of Netlink Technologies.

We reserve the right to reassign or modify IP addresses when necessary.

14. Limitation of Liability

Netlink Technologies shall not be liable for:

  • Data loss
  • Business interruption
  • Loss of profits
  • Service downtime
  • Indirect or consequential damages

Our maximum liability shall not exceed the amount paid for the affected service.

15. Abuse Complaints

All abuse complaints must be responded to within 48 hours.

Failure to respond may result in suspension or termination.

16. Jurisdiction

This Agreement is governed by the laws of India.

All disputes shall fall under the exclusive jurisdiction of the Courts of Delhi, India.

17. Modifications to Terms

We reserve the right to modify these Terms at any time.

Continued use of our services constitutes acceptance of updated Terms.

We believe hosting should be transparent and fair.

Here is what you need to know in simple terms:

  • Pay invoices on time to avoid suspension
  • 30-day refund applies only to first-time shared hosting
  • Domains, VPS, Dedicated, and Reseller plans are non-refundable
  • No spam, phishing, illegal content, or abusive scripts
  • Keep your website secure and updated
  • Always maintain your own backups
  • We are an accredited .IN domain registrar
  • Other domain extensions are registered via authorized partner registrars
  • Delhi courts handle any legal disputes
